TERMS AND CONDITIONS
These terms and conditions outline the rules and regulations for the use of ELA DESIGN's Website, located at https//www.bibiluxestudio.com
1. INFORMATION AND HOW TO CONTACT US
1.1 We are Ela Design, trading as Bibiluxe Studio. contact details 25 Quinton Fields ,Emsworth, PO10 7QF.

It is your responsibility to notify us of any new contact details.
2. YOUR RIGHTS TO END THE CONTRACT FOR CUSTOM SIZE DRESSES MADE TO INDIVIDUAL MEASUREMENTS
2.1 Your contract starts, when you have placed your order and have agreed to our terms and conditions, we have a 7 day cooling off period, in this time you have the right to cancel your order for a full refund. Rush orders are excluded from the 7 day cooling off period. Due to the urgency of rush orders, our 7 day cooling off period is reduced to 24 hours.
2.2 After the 7 day / 24 hour cooling off period has passed, regardless of whether you have confirmed you have read our terms and conditions, the contract comes into existence.
2.3 Full payments and deposit payments are non refundable unless we cannot fulfill your order. The payment cannot be transferred to another person.
2.3 Final Balance payments must be paid upon receiving the final invoice, your deposit / balance contract with Ela design / Bibiluxe Studio is for the full price of your order.
Your garment will then be sent, upon receipt of the cleared payment. Non payment of a remaining balance, will result in legal proceedings to recover the balance payment.
2.4 CHANGING YOUR MIND.
All payments for custom garments are non-refundable after 7 days of your order being placed, on bibiluxestudio.com or via direct payment. This is in accordance with the distant selling laws for goods that are bespoke / made to measure.
2.5 CANCELLATIONS
If in the unfortunate circumstances you have to cancel your wedding, we cannot offer a refund, this applies to ALL CUSTOM SIZE ORDERS, including those that work hasn’t commenced or measurements submitted. We base our business on a made to order basis, if all our customers requested refunds we would have no business, we pre order your fabric, and book production space once we receive your order. We will offer a store credit, which will be valid for 12 months from the date of issue.
3. TERMS AND CONDITIONS FOR STANDARD SIZES 6-20
3.1 REFUNDS
We accept refunds on our standard 6-20 sizes, garments must be returned, unworn, unwashed, with all tags in place. Any garment returned in an unsaleable condition, eg, stains, odour etc, will not be refunded and the garment will need to be returned to you. There is a 50% restocking fee on standard size returns. Original postage fees and 3% Stripe processing fees are non refundable, this applies to try at home samples and appointment cancellations.
3.2 We must be informed of your intention to return within 7 days of receiving, after this time no refunds will be considered under ANY circumstance. Refunds will only be given upon its safe return to us, we will not refund based on proof of postage. Original postage paid is not refundable.
3.3 Returns postage is not prepaid, you will need to ensure the parcel is tracked and insured for the full value.
3.4 Returns from international countries, customs forms must be marked as “RETURNED GOODS” failure to do this, will incur customs fees upon arrival in the U.K, and these fees will be deducted from your final refund.
3.6 Standard Size Exchanges are accepted, original manufacturing lead times and additional shipping fees will apply.
3.7 Any Standard size order cancellation, prior to despatch will incur a 50% admin fee.
3.8 Try at Home sample refunds are refunded, less our £25 admin fee, and less Stripe payment processing fees (approx 3% of the sample order value) If you decide to go ahead and place a order, our £25 admin fee will be refunded. The Stripe payment processing fees are non refundable.
Samples that are not posted back within 7 working days are charged at £25 per day, if you decide to go ahead and place an order these fees are also credited.
4. MEASUREMENTS / SIZES FOR CUSTOM DRESSES MADE TO YOUR INDIVIDUAL MEASUREMENTS.
4.1 It is your responsibility to submit your measurements on time, failure to submit measurements within the 12-20 week production time frame, will result in a later despatch date, if you prefer to keep the same despatch date, then a rush order fee £100 will need to be paid.
We will not be responsible for incorrect measurements, or for any weight loss/gain or any other changes in your measurements after production has commenced.
4.2 Your dress is made to the measurements you provide, this does not guarantee a perfect fit, alterations by a local seamstress should be expected and budgeted for, we do not pay or provide this service.
4.3 Style changes and special requests must be input onto the style change section on our measurement form, any style changes not listed on the form will not be actioned. Email requests for changes will not be actioned unless submitted via our measurement form. Our measurement form link will be on your order acknowledgement email after checkout.
4.4 We have a plus 2 inch tolerance on the final dress, meaning any measurement that is 2 inches above the measurement you provided is acceptable and considered to be measuring within our tolerance guide. Lengths are plus 3-4 inches.
5.5 If you have opted for our fittings in person service, unless you have opted for 3 or more fittings, there might still be additional alterations upon you receiving your finished garment. These alterations are an additional fee ( consultation £65 ) and alterations are charged at an hourly rate, this service is subject to availability and your timeframe.
4.4 BIAS CUT STYLES
If your dress or skirt has been described as bias cut, these styles are exempt from our plus 2 inch tolerance. Due to the nature of the cutting techniques, the finished dress acts like a stretch dress, and cannot be measured flat, it is meant to fit by skimming the body rather than skin tight. This includes the hem, we tend to err on the side of caution, and cut 1inch longer than your given measurement, the nature of bias cutting means that the hems “drop” and they are best shortened with a body in the dress, to get the correct length measurement, you will need to budget and allow time in your timeframe for this to be done.
4.5 All dresses are carefully checked and measured before despatch.
5. MEASUREMENTS FOR STANDARD DRESS SIZES 6-20
5.1 If you have chosen a size from our standard size range, we will need your bust, waist and hip measurements, the dress is NOT cut to your measurements, but we need to double check you have chosen the correct size, before cutting, so there is no fabric waste, and in turn you are not disappointed, no work will commence until these three measurements have been received, if there is a delay in us receiving your measurements, it will in turn delay your despatch date.
5.2 It is your responsibility to submit your measurements on time, failure to submit measurements within the 12 week production time frame, with result in a later despatch date, if you prefer to keep the same despatch date, then a rush order fee £100 will need to be paid.
6. DISPATCH AND DELIVERY
6.1 Dispatch times vary, we will agree on a dispatch date with you, upon receiving your order, as a general guide despatch is 6-12 weeks AFTER we receive your measurements, this timeframe is for both custom sizes and standard 8-16 sizes.
6.2 We are not responsible for delays outside our control, due to unexpected events. If in the rare circumstances this happens, we will be in contact immediately via email, and let you know how we can do to minimise the effect of the delay, provided we do this we will not be liable for delays caused by the event. If there is a risk of a substantial delay, in that we cannot fulfil the contract by the date of the wedding, you may contact us, to end the contract and receive a full refund.
6.3 We will be in contact once your dress is ready to ship, to confirm you will be available to take delivery. Once shipped, it’s your responsibility to track and take delivery of the goods. Mistakes in your address input are your responsibility. If this occurs, please contact us immediately so we can try and help.
7. INTERNATIONAL SHIPPING IMPORT CUSTOMS/DUTIES COSTS
7.1 These fees are NOT prepaid, they are your responsibility to pay and budget for. For more information we suggest you contact your countries customs and excise. If the tracking information shows “delay waiting for receipt of payment” then you will need to contact DHL and arrange payment.
7.2 Any refused customs payments and non delivery of goods that are shipped back to us by our courier will not be refunded. If you then decide you want the goods shipped again, additional shipping fees will be charged along with the return shipment costs from DHL.
8. FAULTY GOODS / MANUFACTURING FAULTS
8.1 In the rare circumstance, your item is faulty when you receive it, please contact info@bibiluxestudio.com. Please provide images and an explanation of the fault, and we will work quickly to resolve any issues.
8.2 The majority of our designs are made from natural fibres, so some irregularities in the weave and fibres are part of the beauty of the fabric, these irregularities are not considered as faulty goods.
9. IMAGES / VARIATION OF STYLES
9.1 Products might vary slightly from their images. All images of the products are for illustrative purposes only, although we have made every effort to display colours accurately, we cannot guarantee that a devices display of colour reflect the true colour of the product, some trims might vary slightly from those of the images. Any major changes will be discussed with you prior to production.
10. ACCIDENTAL DAMAGE
10.1 We are not liable for any damage arising from, any accidents, eg, jewellery snags, or cleaning mishaps.
11. OUR PROMISE TO YOU
11.1 Here at Bibi luxe studio we take our work seriously and take pride in what we do, we have high standards and are proud of our fabulous reviews, we've worked very hard for them. We want you to be happy with your dress, and will never intentionally send a garment that we wouldn't be happy to receive ourselves. That said, mistakes can happen, we are all human. If in the rare circumstance we have made an error, please reach out and we will rectify and resolve any problems, We do ask you to allow time in your wedding timeframe for any eventuality, and we will aim to rectify any errors with the utmost speed and importance. We reserve the right to rectify any mistakes on measurements ourselves, refunds will not be given to fund your own seamstresses costs.
We cannot rectify dresses or partial refund any garment that has been altered by your own seamstress, we will only rectify the dress in its new un-altered condition.
Return postage costs will be refunded, for dresses that we’ve made an error on, upon receipt of the dress, if we find the dress is measuring to your original measurements, we will not undertake the alteration request, unless an additional fee has been agreed upon, return shipping fees will apply.
11.2 Any errors must be reported within 7 days of delivery.
12. HOW WE USE YOUR PERSONAL INFORMATION

13. OTHER IMPORTANT TERMS
13.1 We may transfer our rights and obligations under these terms to another organisation.
13.2 You may only transfer your rights or obligations under these terms to another person if we have agreed in writing.
13.3 This contract is between you and us ( Ela Design) no other person shall have the right to enforce its terms.
13.4 Each of these paragraphs operates separately if any court or relevant authority decides that any of them are unlawful then the remaining paragraphs will remain in force and in full effect.
13.5 Even if we delay in sending this contract, we can still enforce it later, we reserve the right to make changes at any time to our terms and conditions.
13.6 These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
13.7 We reserve the right to make minor changes to our terms and conditions at any time.
14. LICENCE
14.1 Unless otherwise stated, ELA DESIGN and/or its licensors own the intellectual property rights for all material on www.bibiluxestudio.com All intellectual property rights are reserved. You may access this from www.bibiluxestudio.com for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
Republish material from Bibi Luxe or Bibi Luxe studio
Sell, rent or sub-license material from Bibi Luxe or Bibi luxe studio
Reproduce, duplicate or copy material from Bibi Luxe or Bibi Luxe studio
Redistribute content from Bibi Luxe or Bibi Luxe studio
This Agreement shall begin on the date hereof. Our Terms and Conditions were created with the help of the Terms And Conditions Generator and the Privacy Policy Generator.
Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. ELA DESIGN does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of ELA DESIGN, its agents and/or affiliates. 15. LIABILITY
15.1 Ela Design shall not be deemed to be in breach of this contract as a result of acts beyond the reasonable control of Ela Design including without limitation act of God, war, riot, civil commotion or terrorist attack, malicious damage, compliance with any law or governmental order, accident, fire, flood or storm.
15.2 Ela Design brings to your attention the fact that the Wedding Dress is a particularly delicate item and extreme care should be afforded to it. Consequently, Ela Design shall not be liable for any damage to the Wedding Dress arising from fair wear and tear, wilful damage, accident, negligence by you or any third party.
15.3 Ela Design liability for all direct or indirect losses as a consequence of any breach by Ela Design of this contract shall be limited to the price of the Wedding Dress.
15.4 These Terms and Conditions of Sale do not affect your statutory rights as a consumer.
